Under NAFTA, Criterion E applied to certain automatic data processing goods and their parts, specified in Annex 308.1.
Under CUSMA, there is no criterion E. Instead, these goods are included in the CUSMA Uniform Regulations under item (7) on page 13 that states: Special rule for certain goods. A good is originating in the territory of a USMC country if the good is referred to in Schedule II and is imported from the territory of a USMC country.Â
Schedule II, found on pages 124 and 125 of the Uniform Regulations, lists all goods included in the former NAFTA Criterion E.
