Milk Protein Substances with a Milk Protein Content of 85% or more by Weight, Calculated on the Dry Matter, that do not Originate in a NAFTA Country, an EU country or other CETA beneficiary, Chile, Costa Rica or Israel (Item 125.2 on the Import Control List)

This Notice replaces Notice to Importers No. 892 dated December 20, 2016, and will remain in effect until further notice. This Notice is provided pursuant to the authority of the Export and Import Permits Act (EIPA) and its corresponding regulations.

In Brief

Imports of milk protein substances (MPS) with a milk protein content of 85% or more by weight, calculated on the dry matter, that do not originate in a NAFTA country, an EU country or other CETA beneficiary, Chile, Costa Rica or Israel into Canada are subject to import controls under Canada’s EIPA.  Accordingly, an import permit is required for shipments of MPS to enter Canada.  Import permits for shipments of MPS destined to the Canadian market are issued to allocation holders under Canada’s tariff rate quota (TRQ) for MPS, which is administered by Global Affairs Canada.

The access quantity for the MPS TRQ is 10,000,000 kg. The allocation period for the MPS TRQ extends from April 1 to March 31, inclusive.

This Notice to Importers sets out the policies and practices pertaining to the administration of the TRQ, including the allocation, underutilization, return, and transfer policies.  This Notice also explains how to apply for import permits.

Barley Products Tariff Rate Quota (TRQ)

This message pertains to imports of barley products classified under Customs Tariff headings: 11.02, 11.03, 11.04, 11.07, 11.08, 19.01, 19.04 and 23.02 .

The purpose of this message is to inform you that the 2017-18 barley products tariff rate quota will be filled as of 11:59 pm local time on October 18, 2017, and that the within access commitment tariff items will be closed at that time.

Once the TRQ level is reached, General Import Permit No. 20 – Wheat and Wheat Products and Barley and Barley Products (GIP No. 20) will be suspended in respect to the relevant goods until July 31, 2018, and General Import Permit No. 100 – Eligible Agricultural Goods (GIP No. 100) will cover, for the balance of the 2017-18 marketing year, unlimited imports classified under the “over access commitment” tariff item number. Therefore, as of 11:59 p.m. local time on October 18, 2017, importers of barley products may no longer invoke GIP No. 20 when importing such goods.

Please note that after the TRQ level is reached, barley products that qualify under the U.S., Mexican, Chilean, Peruvian or Costa Rican tariff will continue to be assessed at the “within access” lower rate of duty.
