Tomato ADD: Removal of Duties a Possibility

On September 19th, the suspension agreement that will temporarily end the assessment of anti-dumping duties on Mexican grown tomatoes.  At this point, one of three actions will occur:

  1. If no review is requested within 20 days, Commerce will end suspension of liquidation and refund cash deposits.
  2. If a review is requested and the ITC finds the agreement eliminates injury, Commerce will end suspension of liquidation and refund cash deposits at the conclusion of the review.
  3. If the ITC finds that the agreement doesn’t eliminate injury, then the investigation will resume.
