CAPE Phase 3 Access Opens for Plaintiffs

U.S. Customs and Border Protection (CBP) has launched CAPE Phase 3 access to eligible Tranche 3 plaintiffs. Importers who filed litigation and whose attorneys certified their importer of record numbers with CBP on or before July 30, 2026, should now have access to CAPE Phase 3 through the ACE Portal.

Who Is Eligible?

Importers may now have access to CAPE Phase 3 if:

  • They are an active plaintiff in the applicable court action.
  • Their attorney submitted and certified their importer of record number(s) with CBP on or before July 30, 2026.
  • There are no unresolved issues previously identified by the U.S. Department of Justice.

Future Access for Additional Plaintiffs

Importers whose certified importer of record information was submitted after July 30, 2026, may be included in future deployment groups. CBP has indicated that notifications will be sent to plaintiff attorneys as additional CAPE Phase 3 tranches become available.
