On cross border transactions, the party declared to act in this capacity should be aware of the obligations, and have previously agreed to act in this capacity. The FDA has now published a list of parties that have been declared as the FSVP importer on transactions. If you are a U.S. domiciled party, please review the list to verify if your company has been obligated in this capacity.
