DOJ Appeals IEEPA Refund Order

The U.S. Department of Justice (DOJ) has filed an appeal of the universal IEEPA tariff refund order and the U.S. Court of International Trade’s (CIT) direction requiring testimony from CBP Commissioner Scott. The appeal concerns the refund of IEEPA duties already in progress, some of which have been fully completed, as well as future phases of the CAPE system. A response to the order to show cause and motion for stay pending appeal have also been filed.

Clients interested in developing a CAPE refund strategy are encouraged to contact Willson for guidance or consult legal counsel. Please reach out to our U.S. Regulatory Team at regulatoryus@willsonintl.com.
